Umanita Technologies Private Limited owns and operates the ZLATE (hereinafter referred as ‘Company’). The Company is an intermediary between the Buyer and Seller. Buyer and Seller shall have the meaning and definition as contained in the Terms and Conditions available on ZLATE. The Company acts as an online facilitator for the Buyer and Seller for single window negotiation, group negotiation, sale and purchase of products and services.

The Company acts as a platform for verified buyers to connect with verified sellers and initiate negotiation and protected transaction using ESCROW payments. The platform only acts on the basis of instructions received from the Buyer and/or Seller. It is solely the user’s responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, product details and other related information furnished on the website. Any information furnished by the Buyer or Seller, collectively or individually, is not the responsibility of the Company. Company does not endorse the same and shall not be responsible for them. No claim as to the accuracy and correctness of the information for a product or a service by a seller or an intermediary on the Website or Application (“App”) is made, although every attempt is made to ensure that the content is not misleading/ offensive/ inappropriate. In case any inaccuracy is or otherwise improper content is sighted on the App or Website, please report it to the Company.

Nothing contained on the Website or App should be construed as a recommendation to buy any product or service and warrants the authenticity and genuineness of the Buyer and Seller. Company does not endorse any products or services on its Website or App. Users dealing in such products or services shall be doing so entirely at their risk and responsibility.

THE CONTENT AND DOCUMENTS UPLOADED INCLUDING BUT NOT LIMITED TO DOCUMENTS FOR KYC VERIFICATION AND TRANSACTION OF ANY PRODUCT OR SERVICES ARE PROVIDED AND MADE AVAILABLE ON “AS IS” BASIS, WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE COMPANY DOES NOT VERIFY THE DOCUMENTS IN ORIGNAL OR IN PERSON.

ANY DOCUMENTS UPLOADED BY THE BUYER OR SELLER ARE MERELY SCANNED COPIES OF THE DOCUMENTS REQUIRED INCLUDING BUT NOT LIMITED TO DOCUMENTS FOR PROOF OF ADDRESS, PROOF OF IDENTITY, CANCELLED CHEQUE, AGREEMENT TO SELL, ETC. THE COMPANY SHALL NOT BE RESPONSIBLE OF ANY DUPLICITY OR FORGERY OF SUCH DOCUMENTS.

THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR SALE AND PURCHASE OF PROPERTY FOR ANY PURPOSES WHATSOEVER, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, COMPLETENESS OR ACCURACY OF THE INFORMATION, UPDATE OR CORRECTNESS OF THE INFORMATION, FREEDOM FROM COMPUTER VIRUSES, OTHER VIOLATION OF RIGHTS REGARDING SERVICES, PRODUCTS AND CONTENTS OF UPLOADED ON ZLATE.

Company shall be free to refuse any documents uploaded by the buyer or seller if it has reasons to believe that a document may be unauthorized or may violate any law, rule or regulation, or if it has reasonable cause not to honour it. The Company hereby disclaims all claims that may arise due to or in connection with any document due diligence of the transacted on the Website or App.

The services rendered by the Company on its Website or App are in association with various third parties like RBL Bank, payment gateway, escrow agents etc., which are independent service provider, neither the Company nor the said third party make any representation or assurances towards the quality, timeliness or efficiency of their independent services rendered by them on or through the Website or App; and disclaim any service delays, omissions, non-performance, defaults caused in the facilitation services. The Company and/or the said third party make no warranty with regard to any services obtained by parties through the use of the Website or App or the facilitation services. Further, the Company and/or the said third party make no warranty that the underlying services will meet your requirements, or will be uninterrupted, timely, or error free.

Company offers no guarantee no warrantees that there would be satisfactory response or any response at all, once the listing/banner is put on display. Company does not warrant that the access to website or the App will be uninterrupted or error-free or that defects in website or App will be corrected. Any payments made to Company are solely for the purposes of the Negotiation service and Escrow Account provided by the Company. Irrespective of the fact whether a product or a service is transacted in the name of the Buyer by the Seller or not on completion of the process, Company shall be entitled to its service fee for the transaction.

Company is controlled and operated from India and Company makes no representation that the materials are appropriate or will be available for use in other parts of the World as well. If you use Company’s Website or App from outside India, you are entirely responsible for compliance with all applicable local laws as well as international conventions and treaties.
